Troy man Arrested for Buzzard Shot

A Rensselaer County man is facing charges for taking aim at a flying turkey buzzard over a man’s head and across a roadway, according to the New York State Police.
Thomas Fuller, 24, of Troy was arrested Sunday and charged with Reckless Endangerment (2nd Degree) and several ENCON law violations.

Troopers got a call from a man on Johnny Cake Hollow Road in Pittstown of two men shooting in the roadway near his home. When the caller approached the men, Fuller fired a rifle over his head at a flying turkey buzzard, police said. The pair then left.
Later in the day, a Trooper and an ENCON Officer arrived and found a dead rabbit where the men had been standing. Fuller and Daniel S. Kocienski of Petersburgh were eventually located and arrested, police said.

Fuller was charged by ENCON with shooting within 500’ of a dwelling, hunting turkey with a rifle, taking small game out of season, shooting over a public highway, and illegally attempting to take a protected species, the turkey buzzard.

Kocienski was ticketed for taking small game out of season (the rabbit.) The two men were released and are due back in Pittstown Court at a later date. It is believed the turkey buzzard was not injured, police said in a statement.
